Wills

Probate
Probate is the legal process of settling a loved one’s affairs and executing their will. The court will first give creditors a chance to collect on outstanding debts before dividing the remaining estate in accordance with the will’s provisions. If there was no will or the will did not cover the entire estate, the court will follow Georgia’s intestacy laws for any remaining assets. Probate is also the time when legal challenges to a will may be raised.
